不地道的香港China Law & Practice

香港近年来出版关于中国法律的刊物不一，早先时有《中国法律》，近年来则有China Law & Practice——都是既有中文又有其英文译文的双语刊物。这种刊物大陆上的一些读者往往存在着一种错觉：香港英文靠得住！其实不然。《中国法律》之种种舛误，笔者早有论述，就不谈了。本文只谈较后出版的China Law & Practice，以其今年（2003年）出版的２月号及３月号为例，希引起读者的注意——那上边英语颇有舛误：
1．须知我国法律（广义，下同）中叫做《办法》的，不能轻率的以“procedures”一译了之，必须肯定纯属程序性的，才能译之为“procedures”，此其一。（China Law & Practice三月号之“办法”一律译作“procedures”）
2．下列三条中同是“（外国）独资企业”一个法律概念出现在三处，竟各译各的：
a. foreign-invested enterprise
——China Law & Practice, Feb.2003, p.5
b. foreign-owned enterprise
——China Law & Practice, Feb.2003, p.85
c. foreign-funded…enterprise
——China Law & Practice, March 2003, p.6
法律文字，不同于其他文字（如文学）。务必以同一个词语译同一个概念。一旦固定下来，千万不能换花样。如今China Law & Practice竟以三个不同的译名（foreign-invested/foreign-owned/foreign-funded）译之。这种译名混乱、一名三译的情况，是应该受到condemned的！
3．又如很简单的中文“以下简称……”的译法——
a. 以下简称《专项规则》
hereinafter called the “Special Plans”
——China Law & Practice, Feb.2003, p.70
b. 以下简称《条例》
hereafter, “the regulations”
——China Law & Practice，March 2003, p.91
上列两例之错，首先也在于译名不一，一会儿作“hereinafter called”(a)，一会儿又作“hereafter”(b)了；其次，“以下”译作“hereafter”是错误的——唯有“hereinafter”才是对的。
4．但是China Law & Practice所犯的实质性错误远不止此。如只能用于契约（而不能用于法律）的“stipulate”一语，偏给China Law & Practice误用到法律上来了：
The new Provisions have stipulations on capital contributions and charges therein. Article 13 stipulates that…

China Law & Practice的编者和译者都不懂得一个简单的道理：“stipulate (stipulation)”是契约语言而非法律语言！（见ADOMLU）因此，必须把stipulate(stipulation)改为“prescribe(prescription)”之类才是！
当然，我们要实事求是，如下文的“stipulating”，China Law & Practice还是对的——因为它是用于“contract”的嘛：
The two parties shall conclude a contract stipulating technical quality and other responsibilities.

5．法律（广义）规范可大别为两，曰：行为规范与行事规范，行为规范必有行为人，行事规范则涉及法律制度。前者对人不对事，后者则对事不对人。前者要用shall，后者无shall用武之地，此乃基本常识。奈China Law & Practice不谙此，故而犯错，如下列各例中的“shall”都是不应该用而用错了的，务必删除。
a. 本法自2003年9月1日起施行
This law shall come into force…

b. 本规定自2003年2月11起施行
These Provisions shall be implemented…
——China Law & Practice, Feb.2003, p.67
c. 本规定自2003年2月1日起施行
These Provisions shall be implemented…
——China Law & Practice,Feb.2003, p.67
这三个“shall”都是不该用而用错了的。因为，这a、b、c三条都不是行为规范，而法律规范——规定一种法律制度，是就事论事，不应用而用了shall，是一种错误。
正确的译法当是：This Law comes into force…; These Provisions are (to be) implemented…
6．其实，上列例子的略去部分，还隐藏着一个错误，现在把它凸现出来：
a. This Law shall come into force as of September 1, 2003
——China Law & Practice，Feb,2003, p.80
例中的动词是表示瞬息即逝的“come into force”，而这样的动词都用“as of September 1”这样表示时间起点的状语，以致矛盾无法解决，形成错误！
b. 无独有偶，该刊的Editor之一写了一段“告读者”，也犯了类同的错误：
Dear Reader,
In the October 2001 issue of China Law & Practice we covered China’s initial attempt at venture capital investment regulations, which were effective September 1, 2001.…
——China Law & Practice, March 2003, Inside Cover. (Letter from the Editor)
笑话！难道这“regulations”只是在“September 1”一天才是“effective”的吗？！应作“were effective as from (of) September 1, 2001”才是呢。要不，也得改作“become effective September 1, 2001”才是呀。
令人啼笑皆非的是，一方面香港特别行政区出版的China Law & Practice存在诸多差错；另一方面，该刊又得意忘形地告诉读者曰：
High Quality Translation [?]
